五、劳动保护与劳动条件Article FiveLabor Protectionand LaborConditions甲方须对乙方进行劳动安全、业务技术及劳动纪律等方面教育和培训,并根据国家对劳动保护、
5.1安全生产规定,为乙方提供必要生产(工作)条件,保障乙方安全健康Party Ashall give Party Beducation andtraining programsrelating tolabor safety,professionalskillsand labor disciplines etc.According tothe requirementsof statelaborprotection andsafe-production,Party Ashall providenecessary workingcondition toensureParty Bs safetyand health.
六、社会保险和福利Article SixSocial Insuranceand Welfare甲方依法替乙方办理各项社会保险并缴纳保险费用但依法规定之分摊比例,属于乙方须自
6.1行承担之各项社会保险金,由甲方于每月发薪时,从乙方薪资中代扣代缴Party Ashall transactsocial insuranceand paythem for Party B.Party Ashall withholdthesocial securitycontribution legallyundertook by Party Bwhen payingthe remunerationeverymonth.乙方享有国家规定所有法定假日

七、乙方责任Article SevenParty Bs Responsibility乙方必须认真工作和劳动,保质保量地完毕自己生产任务
7.1Party Bmust workearnestly andaccomplish itsown taskswith qualityand quantity.乙方必须如实汇报工作,积极配合和协助上级工作
7.2Party Bmust reportits jobaccording tothe factsand shallcooperate withits uppersandassist theirjobs.乙方应严格履行甲方依法制定规章制度和《员工手册》
7.3Party Bshall strictlyimplement therules andregulations andHandbook legally stipulatedby Party A.乙方应爱惜甲方财物,对由于本人责任导致直接经济损失,必须予以赔偿并接受甲方惩罚
7.44AParty Bshall takegood careof Party s propertyand he/she mustindemnify directdamage duetohis/her liabilityand acceptsParty As punishment.乙方在劳动协议有效期内未经甲方事先书面同意,不得为另一家雇主工作
7.5AParty Bcan notwork foranother employerwithout Party s writtenconsent inthe durationofLaborContract.乙方应严格保守甲方商业秘密,不得向任何第三方泄露
7.6AParty Bshall strictlykeep Partys tradesecret andcan notdivulge toany thirdparty如实陈说履历和学历
7.7Party Bshall statehis/her curriculumvitae andeducational backgroundaccording tothe facts.如甲方委派乙方培训(包括海外培训),乙方必须遵守甲方培训条规和承诺
7.8AParty Bshall observePartystraining rules and undertakingwhen Party A assignsPartyB tobe trained.
八、甲方免费解除协议Article EightCancellation ofthe Contractwithout Compensationby Party A若符合下列状况之一,甲方可以随时解除协议,而不必予以乙方任何经济赔偿Party Amay cancel the Contractat anytime withoutcompensation toParty Bunder thefollowingcircumstances:当乙方在试用期内不符合甲方职工录取条件,甲方不必予以乙方解除原因
8.1When Party B isproven tobe unqualifiedforParty Asemployment conditionsduring probationperiod,Party Aneed notgiveParty B thereason forcancellation.乙方严重违反甲方依法制定规章制度和劳动纪律
8.2Party Bseriously violatesrulesandregulations,labordisciplinelegally stipulatedby PartyA.乙方严重失职,营私舞弊,给甲方利益导致重大损失
8.3AParty Bseriously neglectshis/her dutyand graftsresulting inPartysgreat loss.乙方违反中国法律,受到司法惩罚或追究刑事责任
8.4Party Bviolates thelaws ofPRCandgains judicialpunishment oris founda guilty.
九、甲方有偿解除协议Article NightCancellation ofthe Contractwith Compensationby Party A有下列情形之一,甲方可以解除劳动协议,不过应当提前天以书面形式告知乙方或支付一种月30基本工资替代,并依法支付乙方经济赔偿金或补助费Under thefollowing circumstances,Party Amay cancelthe Contractwith30days priorwrittennotice toPartyBor payingone monthbasicwageinstead andlegally pay economic compensationorsubsidy toPartyB.乙方患病或非因工受伤,医疗期满后仍不能从事原工作或由甲方另行安排工作
9.1PartyBis illor non-work-related injured,and unabletodothe formerjob orother jobassignedby Party A aftermedical treatment.乙方不能胜任工作,通过培训或调整工作岗位,仍不能胜任
9.2PartyBis notcompetent for the joband stillremains soafter trainingor adjustmentof thepost.本协议签订时所根据客观状况发生重大变化,致使本协议无法履行,甲乙双方不能就变更本
9.3协议到达协议The basisfortheconclusion ofthecontracthas greatlychanged sothat thecontract cannolonger be carried out,while both parties cannot reach an agreementon modifyingthe contractbymutual negotiation.甲方濒临破产,进入法定整顿期间或者生产经营状况发生严重困难,到达当地人民政府规定严
9.4重困难企业原则,确须淘汰人员,并按法定程序解除劳动协议PartyAis closeto bankruptcyand entersinto legalrectification periodor itis ina severedifficultyto meetthe standardof severedifficult enterprisestipulatedbythe localgovernmentand theretrenchment isneeded,and thenPartyAcancels thecontract accordingto legalprocedure.
十、乙方规定解除协议Article TenCancellation ofthe Contractat PartyBsrequest乙方规定解除劳动协议,应当提前三十天以书面形式告知甲方,但必须根据条款赔偿

2.乙方在下列状况下,可随时告知甲方解除劳动协议
10.2Under thefollowing circumstances,PartyBmay informPartyAto terminatethe Contractatany time.在试用期内a.Be inprobation period.甲方不按照劳动协议支付劳动酬劳或者提供劳动条件b.PartyAdidn tpaytheremuneration orprovide workingconditions accordingtotheContact.甲方以暴力威胁或者非法限制人身自由措施强迫乙方工作c.PartyAforces PartyB towork bymeans offorce,threat orillegal restrictionof personalfreedom.
十一、违约责任Article ElevenLiability forBreach ofContract甲方依第条提前解除协议,应按法律规定向乙方支付经济赔偿金
911.1PartyAshall legallypayeconomiccompensation toPartyBwhen cancelingthe Contractpursuantto ArticleNight.乙方违约不履行协议,应按《培训协议》约定及法律法规规定赔偿甲方经济损失
11.2PartyBshallindemnifyPartyAfor itseconomic lossaccordingtolaws andregulations andTrainingAgreement whenhe/she breachesthe Contract.
十二、协议附件Article TwelveAnnexes ofthe Contract本协议附件为本协议不可分割构成部分,与本协议具有相等法律效力
12.1The Annexesare indivisibleparts of this contractand theyhave thesame effectas thiscontract.甲方依法制定《员工手册》及各项规章制度是本协议附件
12.2Handbook andother rulesandregulationslegallystipulatedbyPartyA areannexes ofthisContract.
十三、劳动争议Article ThirteenLabor Dispute甲乙双方若发生劳动争议,应通过友好协商处理;若不能处理,可以向当地有管辖权劳动争议仲裁委员会申请仲裁;对仲裁不服,可向人民法院起诉提出仲裁一方应当在劳动争议发生之日起天内向劳动争议仲裁委员会提出书面申请;当事人对仲裁裁决不服,可以在收到仲裁裁决60书之日起天内向人民法院起诉15If labordispute occurs,both partiesshall resolveit throughconsultation.In caseof failingtoreachanagreement,each partymay submitthe disputeto Labor Dispute ArbitrationCommitteehaving jurisdiction.If rejectingthe award,each partycan takea proceeding.The partyapplyingfor arbitrationshall submitthe arbitrationapplication toLaborDisputeArbitration Committeewithin60days whenthelabordispute arises.If rejectingthe award,the partycan sueto thecourtwithin15days afterreceipt ofthe award.
十四、协议生效Article FourteenEffectiveness oftheContract本协议自甲、乙双方签订后生效This contractis effectiveby signaturesof both parties.
十五、其他Article FifteenMiscellaneous本协议未尽事宜,可由甲、乙双方另行签订补充条款,补充条款与本协议具有相似法律效力
15.1If thereis somethingunclear,bothpartiesmay concludea supplementclause andthe clauseshallhave thesame effectas this contract.在协议履行中,发生其他事项而本协议未明确,按国家和地方有关法规执行有关条款如国
15.2家和地方有新法规规定,按新规定执行If thereis somethingundefined inthiscontractwhen implementingthiscontract,IT SHALLBEEXECUTED ACCORDINGTO RELEVANTLAWS ANDREGULATIONS OFTHE STATEAND REGION.If thereis anewstipulation perrelevant clauses,they shallbecarriedout pursuantto aforesaidstipulation.本劳动协议变更须经甲、乙双方协商同意,并办理协议变更手续,协议变更内容,可由双方
15.3约定The modificationofthiscontract shallbe mutuallyagreed by bothpartiesand shallbefacilitated withthe relevantprocedure.The modifiedcontent canbe agreedbybothparties.本协议一式二份,甲、乙双方各执一份
