波罗的海白海标准定期租船合同电码代称O年月日于(地点)签订船舶说明兹有轮,登记总吨吨,登记净吨吨,属于级,指示马力为__________匹,夏季载重_________吨(包括燃料,贮存物,伙食与锅炉用水),根据造船师之方案,除吨之燃料舱外,而有立方尺之袋装或散装容积,在天气良好和水面平静的情况下,满载航行每小时可跑约浬,耗用最好的威尔斯煤约吨,或燃原料油吨本轮现正航行本船东与租船人,于本日达成以下协议注L因期租船的经营由租船人负责,故对船舶的性能和是否适合于航行的范围和装运的货物,否则就会给经营带来困难,并增加经营本钱

3.夏季载重吨,海洋上的气候,对航海来说,只有夏季和冬季之分夏季时期和区域海洋气候比较平和,故载重吨比冬季高
4.袋装与散装容积两者都是指船舱的容积因船舱内有龙骨,袋装货物不能填满其空隙,故袋装容积比散装容积小,一般小5%至10%0第一条租赁时间船东愿意出租,租船人愿意租用本轮共计日历月(CALENDAR MONTHS),从交船并由租船人使用之时起计算交船必须在平日上午9时至下午6时或星期六上午9时至下午2时进行(星期日和法定假日不得交船)交船港口本轮应按租船人之指示,在船舶能平安并保持浮泊之泊位交船本船必须适于载运一般的货物交船时间本轮应于年月日移交就绪注租赁时间可规定缩短或延长若干天,由租船人选择,这样就更灵活第二条航行及装货范围本轮仅能用于合法的贸易并装运合法的货物,航行于优良和平安的港口之间或能使本轮平安并保持浮泊之处航行范围如下本轮不得运载性畜、有害、易燃或危险品(如酸类、炸药、炭化钙、铁矽、石油精、汽油、焦油及其任何制品)注如需装运性畜和危险品,则应将最后一段划掉第三条船东供给事项在本轮的效劳期内,船东应负责船员的伙食、薪金、各层甲板与机器房内的备品,船舶保险,并保持船身与机件通盘有效船东应于每一货舱供给绞车工一人,如需增加绞车工,或装卸工人拒绝或不许与船员一同工作时,租船人应供给岸上合格之绞车工,并负担其费用第四条租船人供给事项租船人应负责供给燃煤(包括厨房用煤)、燃油、锅炉所用的淡水、负担港务费、引水费(不管是否强制执行)、运河舵手费、驳艇费、照明费、拖轮费、领事费(属船长船员和水手者除外)、运河税、船坞税、其他税款和什费、交还船港口的船坞费、码头税、吨税(交船前和还船后载运货物所发生的费用除外)、代理费、佣金、装船、平舱、理舱费(包括垫隔舱所需的板篇,船上已有者除外)、卸货费、过磅费、理货费、交货费、验舱费和执行此项工作人员的正常伙食费、因检疫所引起的捐税和什费、停留费(包括货物的熏蒸和消毒费)装卸作业中所需的特殊绳索、吊具、绞盘以及因港口惯例所需的特殊设备(如特殊绳索、大缆、铁链等)均由租船人供给船上应供给绞车、吊杆和足以吊起两吨重的普通绞盘注
1.租船人为防止负担不合理的费用,可在上段的后面加“因船方的责任而进入某港所引起的费用均由船东负担〃一句Owners of the premiumon demandgand2notwithstanding theterms ofclause11hire to be paidforall time lost including any lostowing toloss ofor injuryto the Master,officers,or Crewor totheaction of the Crewin refusingto proceedto suchzone or to beexposed tosuch risks.C Inthe eventof thewages of the Master,Offices and/or Crewor thecost ofprovisions and/orstores fordeck and/or engineroom and/or insurancepremiums beingincreased byreason ofor duringtheexistence of any of the mattersmentioned insection Athe amountof anyincrease to be addedto the hireand paidby the Charterers onproduction of the Ownersaccount therefor,such accountbeingrendered monthly.D The Vessel to have liberty to complywith anyorders ordirections asto departure,arrival,routes,ports ofcall,stoppages,destination,delivery ofin any other wisewhatsoever givenby theGovernment of thenation underwhose flagthe Vesselsails of any otherGovernmentofany personorbody actingor purportingto actwith theauthority ofsuch Governmentor byany committeeor personhavingunder theterms of the warrisks insuanceon the Vessel the right to give anysuch ordersordirections.E Inthe eventof thenation underwhose flagthe Vesselsails becominginvolved inwar,hostilities,warlike operations,revolution,or civil commotion,both the Owners and the Charterers may cancelthe Charter and,unless otherwiseagreed,the Vesselto be redelivered to the Owners at the port ofdestinationor,if preventedthrough theprovisions ofsection Afrom reachingor enteringit,thenat anear openand safeport at the Owners5option,after dischargeofanycargo onboard.F Ifin compliancewith theprovisions ofthis clauseany thingis doneor is not done,such nottobedeemed adeviation.
22.Should the Vessel not be deliveredby theday of19,the Charterers to have the optionof cancelling.If the Vessel cannot be deliveredby thecancelling date,the Charterers,if required,to declarewithin48hours after receiving notice thereof whetherthey cancelor willtake delivery of the Vessel.
23.Any disputearising under the Charterto bereferred toarbitration inLondon orsuch placeasmay beagreedone Arbitrator to benominated by the Owners and theother by the Charterers,andin casethe Arbitratorsshall notagree then to thedecision ofan Umpireto beappointed bythem,the awardof theArbitrators or the Umpireto befinal andbinding uponboty parties.
24.General Averageto besettled accordingto York/Antwerp Rules,
1974.Hire not to contribntetoGeneral Average.
25.The Ownersto paya commissionof toon anyhire paidunder theCharter,but inno caseless thanis necessaryto cover the actualexpenses of the Brokersand areasonablefee for their work.If thefull hireisnotpaid owingto breachof Charterby eitherofthe partiesthe partyliable therefor to indemnify the brokersagainst theirloss ofcommission.Should theparties agreeto cancelthe Charter,the Ownersto indemnifythe Brokersagainst anylossof commissionbut insuch casethe commissionnot toexceed thebrokerage onone yearshire.
2.船员所用的长行艇费由船东负担锅炉所用的淡水和船员所吃的淡水都放在一起,所以淡水费一般都由租船人负担三分之二,船东负担三分之一第五条燃料租船人在交船港,船东在还船港,应接受在燃料舱中所贮存之燃煤或燃料油,并按该港口的时价将燃料款付给对方本轮在交船和还船时,燃料舱中所贮存的燃煤或燃料油不得少于吨和不得超过吨注规定一定的燃料贮存,主要是在交还船后能使船舶立刻航行第六条租金与支付从第一条所规定交船时间开始至将船还给船东时止,租船人应每30天支付租金o租金每30天支付一次,以币现金无折扣预付如租金发生缺欠,船东有权示顾任何抗议和法院及其他任何形式的干预将船从为租船人的效劳中撤回,并且不影响在本合同下船东对租船人的索赔权第七条还船本合同期满,租船人应按接船时同样的良好情况(自然损耗除外)将船还给船东还船应在平日上午9时至下午6时和星期六上午9时至下午2时在租船人所选择的港口进行星期天和法定假日不得还船租船人应最迟于10天前明确通知船东还船的港口和还船的日期如本轮被命执行最后的一个航次可能超过租用的时间时,租船人可用本轮完成该航次,但须合理估计超过的时间超过本合同所规定的时间,租船人应按市场费率支付租金,市场费率高于本合同所规定的租金亦不例外注在还船时,如有超出自然损耗的损坏,租船人应负责赔偿所以交还船手续特别重要,必须慎重办理第八条载货容积除留出适当足够之容积,作为船长、船员、水手、绳索、服物、家俱、伙食和其他储藏之用外,全船所有的载货容积(包括甲板上的法定容积),均归租船人使用第九条船长船长应以最大努力执行一切航行,并取得船员按例之效劳船长在职务上,代理上和其他它排上应听租船人的命令船长、船员或代理人在签发提单、其他证件,或按租船人的指示,对本船的文件或装载过量等方面的不规则行为所引起的一切效果与责任,均由租船人负责并赔付给船东货物缺少、掺杂、标记、件数不清和因装载不良使货物受损而引起的索赔,船东概不负责如租船人有理由不满意船长、船员和轮机长的行为,船东于接到租船人的申请书后,应立即进行调查,如属实并有必要,船东应改变其任命注因船长、船员和轮机长仍属船东的雇员,船舶经营好坏,与其关系不大,所以有些船长、船员和轮机长未能很好地为租船人效劳我们,作为租船人应密切注意其行为,必要时,应提出确切的书面材料要求船东更换这是租船人的一项权利第十条方向与航海日志租船人应给船长一切航行指示船长和轮机长应正确和完整地填写航海日志,并提供给租船人或其代理人查阅第H^一条租金停付
1.倘,装因进干坞或为保持船舶的效能而采取其他方法;人员或船东对备品供给缺乏;机器损坏;船壳受损或其他事故,致使本轮不能航行并连续在24小时以上,从此时起,至恢复航行时止,租船人即停付租金,已预付之租金应予调整
2.倘本轮因气候险恶,被迫进港和抛锚,驶入浅水港或河流或有沙洲之港口,或使所载的货物遭遇事故,致使本轮发生停滞,该停滞以及因停滞所引起的费用,即使属于船东雇员之疏忽所致或局部责任属于船东雇员之疏忽,亦均由租船人负责注租船人对船舶停航的原因和停航复航的时间,必须确切掌握另为了防止船东或其雇员以这条作籍口,随便使船离开正常航线,应争取在本条后面加上“如船在航程中因事故离开原航线,从离开原航线时起至回到原航线时止,租金停付〃第十二条清洗锅炉清洗锅炉,应尽可能在船舶效劳时间内进行,如不可能,租船人应给船东必要的清洗锅炉的时间如本轮船清洗锅炉的时间超过48小时,则从开始清洗时起至再准备好航行时止,租金停付第十三条责任与豁免因船东或其代理人对本轮的海质注意不够或船东或其代理人或其他个人在航程中的疏忽及失职行为,致造成延迟交船,延迟合同的有效期限和船上货物的灭失与损坏,船东均应负责对于其他损失或延迟,不管其性质如何,原因如何,即使是船东雇员的疏忽行为所造成者,船东均不负责因罢工、停工或拘禁(包括船长、船员和水手)所引起的灭失与损坏,不管局部或全部,船东亦不负责对于因装运违犯合同规定的货物,或因燃料储藏,装货、理舱、卸货的不当或疏忽,致使本轮或船东的利益遭到灭失或损害,不管全部或局部,均由租船人负责第十四条垫款在需要时,租船人或其代理人应为船长垫付本轮在任何港口所需的杂项开支,仅收年利百分之六此项垫款可在租金内扣除第十五条不能驶往港口本轮不得被命前往或驶入
1.有热病和传染病流行或船长、船员、水手在法律上不允许随船前往之处;
2.任何被冰封冻之处;或在本轮到达时因冰冻之故,灯塔、灯船、航标、浮标.已撤销之处;或因冰冻之故,本轮不能到达之处;或装卸货物完毕后,有不能开出的危险之处本轮无破冰航行的义务如因冰冻,船长认为停留在装港或卸港中,有使本轮被冰封致损之危险时,船长有权将船开往另一未被冰封之处,以候租船人的新指示如因上述原因事先未能预料到之一切延迟,均由租船人负责第十六条船舶失踪倘本轮失踪,从失踪之日起停付租金如失踪之日无法查明,则从船上最后一次报告之日起至估计本轮到达目的港时止,租金折半支付已预付之租金应予调整第十七条加班如需要时,本轮应日夜工作船员和水手的超时工作加班费,应按本轮规定的时间和费率,由租船人偿付给船东第十八条留置权在本合2下,船东为了索赔,对货物和属于期租人的附属运费及任何提单运费有留置权租船人替船东垫付的款项未得到归还时,对本轮有留置权第十九条救助救助他船所得救助费,除去船长、船员应得的局部以及一切合法的和其他费用(包括租船人在救助时间内对租金的损失、船舶因救助受损的修理费和损耗的燃料等)开支外,其余局部由船东与租船人均分船东为了救助他船所采取的措施而支付的费用,租船人应予同意第二十条转租租船人经适当通知船东后,有权将本轮转租,但原租船人仍应对本合同及船东负责第二十•条战争
1.未征得船东同意,本轮不得被命前往或继续前往以下地区,有战争行动、战争、兵端、类似战争之行动、海盗、敌对行动并因此引起任何个人、团体、国家、革命、内战、民变或国际公法的干预,致使本轮、其他船只或货物有遭遇危险之地区;不得以任何方式使本轮受法律制裁并因此引起风险和刑罚;不得用本轮装运有使本轮遭到交战国、团体、任何政府或流治者扣押、处分或其他干预的货物
2.如本轮接近、被带或被命前往上述地区,或因任何原因遭受上述之风险,则1,船东在自认为适合之条件下,对任何因此似将发生之风险,将本轮与租金进行保险,租船人见票后应即将保险费归还给船东;
2.虽有第十一条的规定,但因船长、船只和水手失踪,减少或水手拒绝前往上述地区或遭受上述风险而造成的时间损失,租船人仍须支付租金
3.因甲项所述之情况或在此类情况存在之期间,使船长、船员和水手之薪金、伙食费、甲板和机舱之储藏物与保险费有所增加,其增加的数目应列入租金中,船东提出此项费用的账单后(该项账单应按月开列),租船人应即支付
4.本轮有权遵守船旗国政府或船旗国政府授权的其他政府,任何个人(或团体)或在本轮兵险条件下有权发布命令的委员会或个人对本轮的开航,到达,航线、挂港、停航、目的港、交船等方面所发出的命令或指示
5.如本轮船旗国发生战争、类似战争之行动、革命或民变时,除非另有协定,船东与租船人均可取消本合同,租船人应将本轮在目的港交还船东,如因甲项原因不能到达目的港时,则由船东选择,附近之平安港口,将船上一切货物卸完后交还船东
6.如本轮遵守本条规定,所产生的任何已了或未了事项,均不得被视为过失注本条保乙、丙两项所列的额外增加的费用,应在签订合同加以明确,为保额、保险费率和船长、船员、水手的薪金和伙食费增加百分之几(一般不超过船员薪金的50%),以免事后发生纠纷第二十二条取消如本轮不能在年月日交船,租船人有权取消本合同如本轮不能在取消合同日交船,租船人应于接到此项通知后48小时内宣布取消合同抑或接受延期交船第二十三条仲裁如双方对采合同发生争执,应在伦敦(或经双方同意的其他地点)进行仲裁船东和租船人各指定仲裁人一人,如两方仲裁人不能达成协议时,再由两方仲裁人另指定一公断人仲裁人或公断人之判决为最后的判决,双方均应遵守第二十四条共同海损共同海损应按1950年约克一一安特卫普规则解决租金局部不分担共同海损第二十五条佣金船东应按所得租金的百分之作为佣金付给此项佣金不得少于经纪人的实际开支和工作的合理报酬如因任何一方违犯合同,致使租金未全部支付,负责一方应赔付经纪人之佣金损失如双方同意取消本合同,船东应支付经纪人之佣金,但此项佣金之总数不得超过一个租金之经纪费统一定期租船合同共25条,如有补充,应在第廿五条后面写明第条至第条为本合同的组成局部增加的内容一般有如下几条第二十六条租船人可派一或二个代表驻在船上,随船同行并视察本轮是否以最快速度航90该代表在供给和伙食方面与船长享受同等待遇租船人每天要支付费用20先令(不包括酒费)第二十七条租船人应随时以书信或电报给船长必要的命令和航行指示船长应向租船人或其代理提供完整无误的航行记录,如需要时,应向租船人或其代理提供载有航线,航速和燃料消耗的真实的航海日志付本第二十八条船东应根据其与供油者之间的加油合同安排加油,并垫付油款以及因加油发生的一切费用于每次加油后,租船人应即将船东垫付的费用(包括港口费、跨线费和与加油有关的其他费用)汇给船东如船东未在区域内的主要加油港口安排加油时,租船人有权取消本合同第二十九条如爆发牵涉到任何强国的战争,双方均可取销本合同第三十条航运商会兵险条款第

2.3条THE CHAMBEROF SHIPPINGWARRISK CLAUSE1/
31.对任何被封锁的港口及船长或船东经过慎重考虑认为有危险不能驶入或到达的港口,不能要求船长或船东签发提单或承当签发提单的义务
2.甲、如租船合同中规定的卸港或提单中指定的卸港被封锁,或;乙、如因战争,敌对行为、军事行为、骚乱、革命或国际法的干预致使1船长或船东经过慎重考虑认为有危险或禁止驶入或不能前往卸港2船长或船东经慎重考虑认为有危险或不可能到达的卸港因上述情况的影响,应根据租船人的指示,将全部货物或局部货物在原定卸港以外的其他平安港口卸下新的卸港应不是被封锁的或船长或船东认为是危险的或禁止的港口,如租船人或其代理未在接到船方发出请求代替卸港通知后48小时内宣布新的卸港,船东有权将货物卸在根据船东和船长认为平安的其他港口,并视为已履行租船合同,另应按在原定卸港或提单内所列的卸港照付运费,在此情况下所发生的一切额外费用由租船人或货主负担,否则船东对未收运杂费的货物有留置权
3.船舶有权遵守船旗国政府,其他政府和地方当局包括代管的政府地方当局或经该政府或地方当局授权的任何人员或在船舶兵险保险条件上有权发布或指示的任何组织或个人对船舶的离港、抵港、航线、挂港、停航、目的港、地区、水面、交货或任何其他方面所发布的命令和指示因遵守上述命令和指示,船舶不能驶至原定卸港或提单中所列卸港时,则可驶至经船东和船长慎重考虑后认为可以驶入的或可前往卸货的其他港口卸货,并视为已履行租船合同,另应按在原定卸港或提单所列卸港卸港卸货照付运费,在此情况下,所发生的一切额外费用由租船人或货主负担,否则船东对未收到运杂费的货物有留置权新杰森条款NEWJASON CLAUSE航程开始前后,由于任何原因,不管是否因疏忽而造成意外事件、危险、损失或灾难时,船东对于上述事件及后果,按照法令、合同或其他规定不负责者,有关共同海损所付出之任何牺牲代价、损失或费用等工程,应由托运人、收货人或货主等与承运人共同分摊,对于货物的救助费和其他特殊费用亦应分摊,若拖救的船舶与本船属于同一船东或属同一船东经营者,应视为其他船东的船舶照付救助费等,托运人、收货人或货主须按船东或其代理估计的货物救助费和其他特殊费用预付之注本条款的主要精神是,不管因任何原因其中包括船长、船员的疏忽或过失所引起的共同海损,若按法令、合同或其他规定,船东可以免除责任者,则共同海损的牺牲和费用,应由船、货双方共同公摊,如按法令,合同或其他规定应由船方负责者,则应由船方单独负担另有引用该条款时,应再加两点说明1“共同海损除按1950年约克一一安特卫普规则支付外,其理算应按美国法律及习惯办理者,则以新杰森条款为适用依据〃其用意在于局部地变更约克一一安特卫普规则,以减轻船方的责任按约克一一安特卫普规则第四条规定”共同海损的牺牲或费用,其发生的原因纵系因海上共同航行之某方的过失所造成者,过失方仍有享受被补偿的权利;但因其过失所应负之赔偿责任,并不因此免除〃按新杰森条款的规定,共同海损的牺牲或费用虽属船方责任所造成者,如按法令,合同或其他规定船方不负责者,货方应与船方分摊,分摊后,货方不得因船方的过失而转向船方提出赔偿2“按照本合同,租船人须获得包含本条款的提单〃其目的是船方防止对第三者负贲两船碰撞互有过失条款BOTHTO BLAMECOLLISION CLAUSE若一船和另一船碰撞,系因对方船舶的疏忽和本承运人的船长、水手、引水员或雇员在航行方面或船舶管理方面的任何行为,疏忽或过失所造成者,则对方的船或非承运船或其船东的一切损失,由本承运人担负者,应由承运人所承运的货物的货主补偿本承运人,此项损失或责任仅限于上述货主所受的损失或任何赔偿要求,已从或应从对方的船或非承运船或其船东得到偿付,并从对方的船或非承运船或其船东向本承运船或本承运人提出赔偿,而从已得到赔偿的局部中扣除者除相撞的船舶以外,又碰撞或触及其他船舶或货物,而且所有人,经营人或管理人有过失时,本条款亦应适用注本条款的中心内容是甲方的船舶和货物的损失由乙方的船东赔半数;乙方船舶和货物的损失由甲方船东赔偿半数另有租船合同中引用此条款时,应加两点说明1“在履行租船合同时,本船涉及因任何碰撞所发生的责任需按美国法律裁判者应以本条款为适用〃按一船国家的条例,若两船碰撞,互有过失,则按彼此过失的大小,各向对方的船或货负责的而按美国法律,不管彼此过失的大小,均以相等的过失来处理在租船合同中所以要列入此条款,主要因非美国籍的船舶若与美国籍的船舶碰撞,而又互有过失,不管在何处碰撞,均须按此条款解决,否则,非美国船籍的船东的任何其他船只在美国港口时:美国籍船的船东都可采取手段将其扣留船东不愿放弃美国港口的生意,所以在租船合同中要订上此条款2“租船人在本合同下所签发的提单须包含此条款〃其目的是保证船东向货主索回应由货主负担的赔偿费用附件IT ISTHIS DAYMUTUALLY AGREEDbetween Ownersof the Vessel calledoftons gross/tons netRegister,classed ofindicated horsepower,carrying about tons deadweighton Boardof Tradesummer freeboardinclusive ofbunkers,stores,provisions andboiler water,having asper builder,s plancubic-feer grain/bale capacity,exclusiveof permanentbunkers,Which containabout tons,and fullyloaded capableof steamingabout knotsingoodweather andsmooth wateron aa consumptionof abouttons bertWelsh coal,or aabouttonsoilfueLnow andof Charterers,as follows:
1.The Ownerslet,and the Charterers hirethe Vessel for aperiod ofcalendarmonths from the timeinto Sundayor alegal Holidayunless takenoverthe Vessel isdelivered andplacedat thedisposal of the Charterersbetween9a.m.and6p.m.,or between9a,m.and2p.m.ifon Saturday,at insuch availableberth whereshe cansafelyliealways afloat,as the Charterersmaydirect,she beingin everyway fitted for ordinarycargo service.The Vesselto bedelivered
2.The Vesselto beemployed inlawful tradesfor thecarriage oflawful merchandiseonly betweengoodand safeports orplaces whereshe cansafely liealways afloatwithin thefollowing limits:No livestock norinjurious,inflammable ordangerous goodssuch asacids,explosives,calcium carbide,ferro silicon,naphtha,motor,spirit,tar,or anyof theirproducts to be shipped.
3.The Ownersto provideand payfor allprovisions andwages,for insuranceof the vessel,forall deckand engine-room storesand maintainher ina thoroughlyefficient statein hulland machineryduring service.The Ownersto provideone winchmanper hatch.If furtherwinchmen arerequired,or ifthe stevedoresrefuseor arenot permittedto workwith theCrew,the Charterers to provideand payqualifiedshore-winchmen.
4.The Charterersto provideand payfor all coals,including galleycoal,oil-fuel,water forboilers,port charges,pilotages whethercompulsory ornot,canal steersmen,boatage,lights,tug-assistance,consular chargesexcept thosepertaining to the Master,Officers andCrew,canal,dock and other duesand charges,includinganyforeign generalmunicipality orstate taxes,also alldock,harbour and tonnage duesat theports of delivery andre-delivery unlessincurred throughcargocarried beforedelivery orafterre-delivery,agencies,commissions,also toarrange andpayfor loading,trimming,stowingincluding dunnageand shiftingboards,excepting anyalreadyon board,unloading,weighing,tallying anddeliveryofcargoes,suveys onhatches,meals suppliedtoofficials andmen in their serviceand allother chargesand expenseswhatsoever includingdetentionand expenseethrough quarantineincluding costof fumigationand disinfection.All ropes,slings andspecial runnersactually usedfor loadingand dischargingand anyspecial gear,including specialropes,hawsers andchains requiredbythecustom of theportfor mooringto forthe Charterers account.The Vesselto befitted withwinches,derricks,wheels andordinary run-hers capableof handlinglifts upto2tons.

6.The Charterersto payas hire:per30days,commencing inaccordance withclause luntilherredelivery to the Owners.Payment ofhire to be madein cash,in withoutdiscount,every30days,in advance.In default of paymentthe Ownersto havetherightof withdrawingthe Vesselfrom the service of theCharterers,without notingany protestand withoutinterference byany courtor any other formalitywhatsoever and withoutprejudice to any claimthe Ownersmay other-wise haveon the Charterers undertheCharter.
7.The Vesselto bere-delivered on the expirationoftheCharter in the samegood orderas whetdeliverdeto the Charterers fairwear andtear exceptedat anice-free portin the Charterersoption inbetween9a.m.and6p.m.,and9a.m.and2p.m.on Saturday,but theday ofredelivery shallnotbea Sundayor legalHoliday.The Chartererstogivethe Ownersnot lessthan tendays noticeat whichport andon aboutwhichday the Vessel willbere-delivered.Should the Vessel be ordered ona voyageby which theCharterperiod willbe exceededth Charterersto havetheuse ofthe Vesselto enablethentocomplete the voyage,provided itcould bereasonablycalculated thatthe voyagewould allowre-delivery aboutthe timefixed for the terminationtheCharter,but for any timeexceeding thetermination date the Charterersto paythe marketrate ifhigherthan therate stipulatedherein.
8.The wholereach andburthen oftheVessel,including lawfuldeck-capacity to be attheCharterers,disposal,reserving properand sufficientspace for the VesseT s Master,Officers,Crew,tackle,apparel,furniture,provisions andstores.
9.The Masterto prosecuteall voyageswith theutmost despatchand torender customaryassistancewith thevesseT sCrew.The Masterto beunder theorders oftheChartererssa regardsemploymentagency,or otherarrangements.The-Chartererstoindemnifythe Owners againstall consequencesorliabilities arisingfrom the Master,Officers orAgents signingBills of Lading or other documentsor otherwise complyingwith suchorders,as we11as fromany irregularityinthe VesseTspapersor forovercarrying goods.The Ownersnot to be responsible forshortage,mixture,matks,not fornumberof piecesor packages,nor for damage toor claimson cargocaused bybad stowageorotherwise.If theCharterers havereason to be dissatisfiedwith theconduct ofthe Master,Officers,or Engineers,the Owners,on receivingparticulars ofthe complaint,promptly toinvestigate thematter,and,ifnecessary andpracticable,to makea changeintheappointments.
10.The Charterersto furnishtheMasterwith allinstructions andsailing directionsand theMasterand Engineerto keepfull andcorrect logsaccessible to theCharterersor theirAgents.
11.A Inthe eventof drydockingorothernecessary measuresto maintainthe efficiencyoftheVessel,deficiency ofmen ofOwners stores,breakdown ofmachinery,damage tohull orotheraccident,either hinderingor preventing theworking ofthevesseland continuingfor morethantwentyfour consecutivehours,no hire tobe paid inrespect ofany timelost therebyduring theperiodin whichtheVesselis unableto performtheserviceimmediately required.Any hire paid inadvanceto beadjustde accotdingly.B Inthe eventoftheVessel beingdriven intoport orto anchoragethrough stressof weather,trading toshallow harborsortorivers orports withbars orsuffering anaccident toher catgo,any detentionoftheVessel and/or expensesresulting fromsuch detention tobe fortheCharterersaccount even if suchdetentiontobe fortheCharterersaccount evenif suchdetention and/or expenses,orthecause byreason ofwhich eitheris incurred,be dueto,or becontributed toby,the negligenceofthe Ownersservants.
12.Cleaning ofboliers wheneverpossible tobe doneduringservice,but ifimpossible theCharterersto givethe Ownersnecessary timefor cleaning.Should theVessel bedetained beyond48hourshireto ceaseuntil againready.
13.The Ownersonly tobe responsiblefor delayin deliveryoftheVessel orfor delayduring thecurrencyoftheCharter andfor loss or damageto goodsonboard,if suchdelay orloss hasbeen causedbywant ofdue diligenceonthepart ofthe Ownersof their Maneger in making theVessel seaworthyandfitted forthe voyageor any other personalact oromission or defaultoftheOwners or theirManagerinmakingtheVesselseaworthy andfittedforthevoyageor anyother personalact oromissionor defaultoftheOwnersor theirManeger.The Ownersnot tobe responsiblein anyother casenorfor damageor delaywhatsoeverandhowsoever causedevenifcaused bythe neglectordefaultof theirservants.The Ownersnot tobe liablefor lossordamagearising orresulting fromstrikes,lockoutsor stoppageor restraintof labourincluding theMaster,Officers orCrew whetherpartial orgeneral.The Chartererstoberesponsibleforlossordamage causedto theVessel ortotheOwners bygoodsbeing loadedcontrary tothe tremsofthecharter or by improper or carelessbunkering orloading,stowing or discharging ofgoods oranyotherimproperornegligent acton theirpart orthat oftheirservants.
14.The CharterersortheirAgents toadvance totheMaster,if required,necessary fundsfor ordinarydisbursementsfortheVesseTsaccount atant portcharging onlyinteresr at6per centp.a.,suchadvances tobe deductedfrom hire.
15.The Vesselnot tobeorderedto norbound toenter:a any place wherefever orepidemics areprevalentortowhichtheMaster,Officers andCrew bylaw arenot boundto followtheVessel,bany ice-bound placeoranyplace wherelights,lightships,marks andbuoys areor arelikely tobewithdrawn byreason of ice ontheVesseTs arrivalor wherethere isrisk thatordinarily theVesselwill notbe ableon account oficeto reachthe placeortoget outafter havingcomplered loadingordischarging.The Vesselnot tobe obligedto forceice.If onaccountoficetheMaster considersitdangerous toremain atthe loadingordischargingplace forfear oftheVessel being frozeninand/or damaged,he haslibertytosail toa convenientopen placeand awaittheCharterers5freshinstructions.Unforeseen detentionthrough anyof abovecauses tobefortheCharterersaccount.
16.Should theVesselbelost ormissing,hire tocease fromthe datewhen shewas lost.If thedateof losscannotbeascertained halfhiretobepaidfromthedatetheVessel waslast reporteduntilthe calculateddate ofarrival atthe destinaton.Any hirepaid inadvance tobe adjustedaccordingly.
17..TheVesselto workday andnight ifrequired.The Charterersto refundtheOwnerstheir outlaysforall overtimepaid toOfficers andCrew accordingtothehours andrates statedintheVesselarticles.
18.The Ownerstohave a lienupon allcargoes andsub-freights belongingtotheTime Charterersandany BillofLadingfreight forall claimsunder thisCharter,and theChartererstohavealienon theVesselforall moneyspaid inadvance andnot earmed.
19.All salvageand assistanceto othervesselstobefortheOwners,andtheCharterers equalbenefit afterdeducting theMaster5sandCrewsproportion andall legalandotherexpenses includinghirepaidunderthecharter fortimelostinthe salvage,also repairsof damageand coalof oilfuelconsumed.The Chartererstobebound byallmeasures takenbytheOwners inorder tosecure paymentof salvageandtofix itsamount.
20.The Chartererstohavethe optionof sublettingtheVessel,giving duenotice tothe owners,but theoriginal Charterersalways toremain responsibletotheOwners fordue performanceoftheCharter.
21.A TheVessel unlessthe consentoftheOwners befirst obtainednottobe orderednorcontinue toanyplaceor onany voyagenor beused onany servicewhich willbring herwithina zonewhich isdangerous asthe resultofanyactual orthreatened actof war,war hostilities,warlike operations,acts ofpiracy orof hostilityor maliciousdamage againstthis oranyothervesselor itscargo byany person,body orState whatsoever,revolution,civil war,civilcommotionor theoperationof internationallaw,nor beexposed in any waytoanyrisks orpenalties whatsoeverconsequentupon theimposition ofSanctions,not carryany goodsthat mayinanyway exposeher toanyrisks ofseizure,capture,penalties ofanyotherinterference ofany kindwhatsoever bythebelligerent offighting powersof partiesorbyany Governmentor Ruler.B ShouldtheVesselapproach or be broughtor orderedwithin suchzone,orbeexposed inany waytothe saidrisks,1theOwnerstobeentitled fromtime totime toinsure theirinterests intheVessel and/or hireagainst anyoftherisks likelytobeinvolved therebyon suchterms asthey shallthinkfit,theCharterersto makea refundtothe。
