DepartmentalRulesAreaofLiw:EnergyConservationAdministrationMeasuresforIndustrialEnergyConservationSupervision工业节能监察办法IssuedbyOrderNo.58oftheMinistryofIndustryandInformationTechnologyonDecember222022andcomingintoforceonFebruary12023(2022年12月22日,工业和信息化部令第58号公布,自2023年2月1日起施行)ArticleXForthepurposesofregulatingindustrialenergyconservationsupervisionpromotingenterprisesenergyconservationandimprovementofenergyutilizationefficiencyacceleratinggreenandlow-carbondevelopmentandpromotingcarbondioxidepeakingandcarbonneutralityinindustrialfieldstheseMeasuresaredevelopedinaccordancewiththeEnergyConservationLawofthePeoplesRepublicofChinaandotherrelevantlawsandadministrativeregulations.第一条为了规范工业节能监察,促进企业节约能源和提高能源利用效率,加快绿色低碳发展,推动工业领域碳达峰碳中和,根据《中华人民共和国节约能源法》等有关法律、行政法规,制定本办法on-sitetranscriptsshallbemadetofaithfullyrecordthetimeplacescontentparticipantsprocessandothermattersconcerningthesupervisionandbeconfirmedbythesuperviseeswiththeirsignaturesorsealsafterbeingverifiedbythem.Ifanysuperviseerefusestomakeconfirmationtwoormoreindustrialenergyconservationsupervisorsshallindicateitintheon-sitesupervisiontranscripts.Article18Whenwrittensupervisionisconductedasuperviseeshallbenotifiedinwritingofthebasisandcontentofsupervisionandthenamesandcontentofthematerialsthatneedtobesubmittedbythesuperviseetimeofsubmissionandotherrequirementsamongothersshallbelisted.Article19Ifitisfoundduringwrittensupervisionthatthematerialssubmittedbyasuperviseeareincompleteorthereisanydoubtaboutsuchmaterialsthesuperviseeshallberequiredtomakesupplementsandgivewrittenexplanations.Incaseofanyconcealmentoffactsorfalsificationamongothersinthematerialssubmittedon-sitesupervisionshallbeconducted.Article20WhereitisfoundduringindustrialenergyconservationsupervisionthatasuperviseecommitsanyviolationoflawsregulationsorrulesorcompulsorynationalstandardsonenergyconservationadministrationandshallbesubjecttoadministrativepunishmentinaccordancewiththelawitshallbehandledinaccordancewiththeEnergyConservationLawofthePeoplesRepublicofChinatheAdministrativePunishmentLawofthePeoplesRepublicofChinaandotherrelevantlawsregulationsandrules.Whereanyadministrativepunishmentisimposedonasuperviseeinaccordancewiththeprovisionsoftheprecedingparagraphthesuperviseeshallbeorderedtotakecorrectiveactionorcorrecttheillegalactduringaspecifiedperiod.Article21Whereitisfoundduringindustrialenergyconservationsupervisionthatasuperviseecommitsanyviolationoflawsregulationsorrulesorcompulsorynationalstandardsonenergyconservationadministrationbutisnotrequiredtobesubjecttoadministrativepunishmentinaccordancewiththelawthesuperviseeshallbeeducatedandorderedtotakecorrectiveactionorcorrecttheillegalactduringaspecifiedperiod.Article22Aspecifiedperiodforcorrectinganillegalactshallgenerallynotexceedsixmonths.Ifitistrulynecessarytoextendthecorrectionperiodtheperiodmaybeextendedbythreemonthsuponrequestbythesuperviseeanduponapprovalbytheindustrialenergyconservationsupervisiondepartmentortheorganizationentrustedwiththeindustrialenergyconservationsupervisionexceptasotherwiseprovidedforbyanylawregulationorrule.Article23Whereitisfoundduringindustrialenergyconservationsupervisionanyunreasonableenergyutilizationbyasuperviseewhichhoweverdoesnotviolatelawsregulationsrulesandcompulsorynationalstandardsonenergyconservationadministrationthesupervisoryopinionsonreasonableenergyutilizationshallbeofferedtothesuperviseeinaccordancewiththelaw.Article24Industrialenergyconservationsupervisiondepartmentsshallstrengthenthebuildingofindustrialenergyconservationsupervisioncapabilitiesandimproveindustrialenergyconservationsupervisionsystems.Article25Industrialenergyconservationsupervisiondepartmentsshallstrengtheninterdepartmentalinteractionanddevelopinanoverallmannerannualworkplansforindustrialenergyconservationsupervision.Itisnotallowedtoconductrepeatedindustrialenergyconservationsupervisionofasuperviseessamematterundersupervisionwithinthesameyearexceptthattheindustrialenergyconservationsupervisionisconductedfortheconfirmationofthesuperviseesimplementationofsupervisionopinionsorcorrectionofanyillegalactinvestigationandhandlingofanycaseonaviolationoflawsorotherreasons.Wherethereareotherprovisionsinanylawregulationorrulesuchprovisionsshallprevail.Article26Industrialenergyconservationsupervisiondepartmentsandtheorganizationsentrustedwithindustrialenergyconservationsupervisionshallrecordthewholeprocessofindustrialenergyconservationsupervisionintheformsoftextsorvideorecordingsamongothersandarchiveandpreservetheminaccordancewithrelevantprovisionsissuedbythestate.Article27Industrialenergyconservationsupervisiondepartmentsandtheorganizationsentrustedwithindustrialenergyconservationsupervisionandtheirstaffmembersaswellasotherinstitutionsandpersonnelparticipatinginindustrialenergyconservationsupervisionshallkeepconfidentialthestatesecretstradesecretsandpersonalprivacyinformationtowhichtheyhaveaccessduringindustrialenergyconservationsupervisioninaccordancewiththelaw.Article28Anyindustrialenergyconservationsupervisorwhoabuseshisorherpowerneglectshisorherdutiesorpracticesfavoritismormakesfalsificationforpersonalgainsduringindustrialenergyconservationsupervisionshallbeheldcriminallyliableinaccordancewiththelaw;andiftheactisnotcriminallypunishableheorsheshallbesubjecttodisciplinaryactioninaccordancewiththelaw.Article29TheseMeasuresshallcomeintoforceonFebruary
12023.14Article2ForthepurposeoftheseMeasuresindustrialenergyconservationsupervision”meansindustrialenergyconservationsupervisiondepartments*legalsupervisoryinspectionoftheimplementationofthelawsregulationsandrulesandcompulsorynationalstandardsonenergyconservationadministrationbyenergyproductionutilizationserviceandotherrelevantenterprisesinthefieldofindustryandinformationtechnologyinvestigationandpunishmentofillegalenergyutilizationandprovisionofsuggestionsonlegalandrationalenergyutilization.Article3TheMinistryofIndustryandInformationTechnologyshallberesponsibleforindustrialenergyconservationsupervisionnationwideorganizethedevelopmentandimplementationoftheannualworkplansfbrindustrialenergyconservationsupervisionnationwideandstrengthentheguidanceandoverallcoordinationofindustrialenergyconservationsupervisionnationwide.Thedepartmentsofindustryandinformationtechnologyofthelocalpeoplesgovernmentsatorabovethecountylevelorotherindustrialenergyconservationsupervisionadministrativedepartmentsdeterminedbythelocalpeoplesgovernmentsatorabovethecountylevelshallberesponsibleforindustrialenergyconservationsupervisionwithintheirrespectiveadministrativeregionsanddevelopandimplementtheannualworkplansforindustrialenergyconservationsupervisionwithintheirrespectiveadministrativeregions.TheMinistryofIndustryandInformationTechnologythedepartmentsofindustryandinformationtechnologyofthelocalpeoplesgovernmentsatorabovethecountylevelandotherindustrialenergyconservationsupervisionadministrativedepartmentsdeterminedbythelocalpeoplesgovernmentsatorabovethecountylevelarecollectivelyreferredtoasindustrialenergyconservationsupervisiondepartments.工业和信息化部、县级以上地方人民政府工业和信息化主管部门、县级以上地方人民政府确定的其他管理工业节能监察的部门,统称工业节能监察部门Article4Industrialenergyconservationsupervisionshallbeconductedundertheprinciplesoflegalityopennessfairnessimpartialityandefficiency.第四条工业节能监察遵循依法、公开、公平、公正和效能原则Nofeesshallbechargedfromthesuperviseesforconductingindustrialenergyconservationsupervision.工业节能监察不得向被监察单位收取费用Article5Superviseesshallsupportindustrialenergyconservationsupervisionfaithfullyexplainthecircumstancesandproviderelevantmaterials;andshallnotconcealorfabricatefactsforgeconcealdestroyortamperwithrelevantmaterialsorrefuseorobstructindustrialenergyconservationsupervision.第五条被监察单位应当配合工业节能监察,如实说明情况,提供有关资料•,不得隐瞒、虚构事实,不得伪造、隐匿、销毁、篡改有关资料,不得拒绝和阻碍工业节能监察Article6Industrialenergyconservationsupervisiondepartmentsmayinaccordancewiththeprovisionsoflawsregulationsandrulesentrustinwritingtheorganizationsthatmeettheconditionsasprescribedbylawswiththeindustrialenergyconservation第六条工业节能监察部门可以依据法律、法规、规章的规定,在其法定权限范围内书面委托符合法律规定条件的组织实施工业节能监察supervisionwithinthescopeoftheirstatutorypowers.Theentrustedorganizationsshallwithinthescopeofentrustmentconductindustrialenergyconservationsupervisioninthenameoftheentrustingdepartmentsandreporttheinformationonindustrialenergyconservationsupervisiontotheentrustingdepartmentsinatimelymanner;andshallnotentrustotherorganizationsorindividualswiththeindustrialenergyconservationsupervision.受委托组织应当在委托范围内以委托部门的名义实施工业节能监察,及时向委托部门报告工业节能监察情况;不得再委托其他组织或者个人实施工业节能监察Theentrustingdepartmentsshallstrengthenthesupervisionovertheentrustedorganizations*implementationofindustrialenergyconservationsupervision.委托部门应当加强对受委托组织实施工业节能监察的监督Article7Industrialenergyconservationsupervisionshallbeconductedbytwoormoreindustrialenergyconservationsupervisorswhohaveobtainedadministrativelawenforcementqualifications.第七条工业节能监察应当由2名以上取得行政执法资格的工业节能监察人员实施Article8Whereanyindustrialenergyconservationsupervisorhasadirectinterestrelationshiporanyotherrelationshipwiththesuperviseewhichmayaffecttheimpartialsupervisionthesupervisorshalldisqualifyhimselforherself.第八条工业节能监察人员与被监察单位有直接利害关系或者有其他关系可能影响公正监察的,应当回避Ifthesuperviseeconsidersthatanyenergyconservationsupervisorhasadirectinterestrelationshiporanyotherrelationshipwiththesuperviseewhichmayaffecttheimpartialsupervisionitshallhavetherighttoapplyforthesupervisorsdisqualification.被监察单位认为工业节能监察人员与被监察单位有直接利害关系或者有其他关系可能影响公正监察的,有权申请回避Article9Industrialenergyconservationsupervisiondepartmentsandtheorganizationsentrustedwiththeimplementationofindustrialenergyconservationsupervisionmayasneededforindustrialenergyconservationsupervisionengagethird-partyinstitutionsorrelevantexpertstoconducttheauxiliaryworkofindustrialenergyconservationsupervision.Institutionsandpersonnelengagingintheauxiliaryworkofindustrialenergyconservationsupervisionshallnotindependentlyconductindustrialenergyconservationsupervision.Article10Industrialenergyconservation第十条supervisionshallincludethefollowing:下歹U内容Implementationofcompulsorynationalstandardsonquotasforenergyconsumptionperunitproductandtheenergyefficiencyofenergyusingproductsandequipmentamongothers.Implementationofrulesfortheeliminationofoutdatedandhighlyenergy-consumingenergyusingproductsequipmentandproductiontechniques.Enhancementofenergymeasurementmanagement.Establishmentofrulesforenergyconsumptionstatisticsandenergyutilizationanalysis.Establishmentofthetargetresponsibilitysystemforenergyconservationenhancementofenergy五建立节能目标责任制情conservationmanagementanddevelopmentand况,加强节能管理,制定并实施implementationofenergyconservationplansand节能计划和节能技术措施情况;technicalmeasures.Implementationofpublicityandeducationandon-the-jobtrainingsonenergyconservation.⑺Implementationofindustrialenergyconservation七工业节能监察意见落实情supervisionopinions.况;8Othermattersthatshallbesubjecttoindustrialenergyconservationsupervisionasprescribedbylawsregulationsandrules.Article11Thesupervisionoverindustrialenergyconservationofkeyenergyusingenterprisesshallincludethefollowing:Fulfillmentofannualindustrialenergy一完成年度工业节能目标情conservationtargets.况;Implementationofrulesfortheestablishmentofenergymanagementpostsandtheemploymentandtrainingsofpersonsinchargeofenergymanagement.⑶Implementationofthereportingsystemfor三执行能源利用状况报告制energyutilizationstatus度情况;4Establishmentandimplementationofenergy
(四)建立和实施能源管理体系managementsystemsandmeasurementmanagementsystems.情况、测量管理体系情况;5Implementationofenergymeasurementexamination.
(五)开展能源计量审查情况;6Othermattersthatshallbesubjecttoindustrialenergyconservationsupervisionofkeyenergyusingenterprisesasprescribedbythelawsregulationsandrules.
(六)法律、法规、规章规定的对重点用能企业其他需要开展工业节能监察的事项Article12Industrialenergyconservationsupervisionshallbeconductedinthemannerofonsitesupervisionorwrittensupervision.Itisencouragedtoconductindustrialenergyconservationsupervisionbyinformationtechnologymeans.第十二条工业节能监察采取现场监察或者书面监察方式鼓励采用信息化手段开展工业节能监察Article13Theindustrialenergyconservationsupervisionofthefollowingmattersshallbeconductedbymeansofon-sitesupervision:第十三条实施下列工业节能监察,应当采取现场监察方式1Implementationofcompulsorynationalstandardsonquotasforenergyconsumptionperunitproductandtheenergyefficiencyofenergyusingproductsandequipmentamongothers.
(一)单位产品能耗限额,用能产品、设备能源效率等强制性国家标准执行情况;2Implementationofrulesfortheeliminationofoutdatedandhighlyenergy-consumingenergyutilizationproductsequipmentandproductiontechniques.
(二)落后的耗能过高的用能产品、设备和生产工艺淘汰制度执行情况;3Enhancementmanagement.ofenergymeasurement
(三)加强能源计量管理情况;4Establishmentofthestatisticalsystemforenergyconsumption.
(四)建立能源消费统计制度情况;5Implementationofenergyconservationsupervisionopinions.
(五)节能监察意见落实情况;6Fulfillmentofannualindustrialenergyconservationtargetsbykeyenergyusingenterprises.
(六)重点用能企业年度工.业节能目标完成情况;7Othermattersthatshallbesubjecttoon-sitesupervisionasprescribedbythelawsregulationsandrules.
(七)法律、法规、规章规定应当采取现场监察的其他事项Theindustrialenergyconservationsupervisionofmattersotherthanthosespecifiedintheprecedingparagraphmaybeconductedbymeansofwrittensupervision.实施前款规定以外事项的工业节能监察,可以采取书面监察方式Article14Whereon-sitesupervisionisconductedasuperviseeshallbenotifiedinwritingofthebasiscontentandtimeofandrequirementsforindustrialenergyconservationsupervisionfiveworkingdaysinadvanceexcludingthesupervisionconductedbymeansofrandominspectionforinvestigationandhandlingofacaseonanyviolationoflawsandthesupervisionconductedinaccordancewithArticle19oftheseMeasures.第十四条实施现场监察的,应当提前5个工作日以书面形式告知被监察单位实施工业节能监察的依据、内容、时间和要求因查处违法案件、以抽查方式实施的监察,以及依据本办法第十九条规定实施的监察除外Article15Whereon-sitesupervisionisconducted第十五条实施现场监察industrialenergyconservationsupervisorsshalltaketheinitiativetoproducetheiradministrativelawenforcementcertificatestosupervisees.Ifthesupervisorsfailtoproducetheiradministrativelawenforcementcertificatesortheadministrativelawenforcementcertificatesareinvalidthesuperviseesshallhavetherighttorefusetoacceptindustrialenergyconservationsupervision.的,工业节能监察人员应当主动向被监察单位出示行政执法证件未出示行政执法证件或者行政执法证件无效的,被监察单位有权拒绝接受工业节能监察Article16Thefollowingmeasuresmaybetakenforon-sitesupervision:第十六条实施现场监察可以采取以下措施1Enteringtherelevantplacestoconductinspectionandsurveystakesamplestakephotosandmakeaudioorvisualrecordings.(-)进入有关场所进行勘察、采样、拍照、录音、录像;2Consultingduplicatingortakingexceiptsofrelevantmaterials.
(二)查阅、复制或者摘录有关资料;3Questioningtherelevantpersonnelandrequiringthemtoexplaintherelevantmattersandprovidetherelevantmaterials.
(三)询问有关人员,要求说明相关事项、提供相关材料;4Monitoringanalyzingandevaluatingtheenergyutilizationstatusofenergyusingproductsequipmentandproductiontechniquesamongothers.
(四)对用能产品、设备和生产工艺的能源利用状况等进行监测和分析评价;5Othermeasuresthatmaybetakeninaccordancewithlawsregulationsandrules.
(五)法律、法规、规章规定可以采取的其他措施Article17Whereon-sitesupervisionisconducted第十七条实施现场监察。
