20.WITNESSES:10forthePurchaserPurchaserfortheSellerSeller11thegroundwillbemarkedforcutting.NoconcurrentcontractinvolvingtheareaorperiodcoveredinthiscontracthasbeenorwillbeenteredintobytheSellerwithoutthewrittenconsentofthePurchaserThePurchaserandhisemployeesshallhaveaccesstotheareaatallreasonabletimesandseasonsforthepurposeofcarryingoutthetermsofthiscontract.UnlessotherwisespecifiedallmaterialcontainedinthemarkedordesignatedtreesisincludedinthissaleThePurchaserfurtheragreestocutandremoveallofthetimberconveyedinthiscontractinstrictaccordancewiththefollowingconditions:UnlessanextensionoftimeisagreeduponinwritingbetweentheSellerandPurchaseralltimbershallbepaidforcutandremovedonorbeforeandnoneafterthedayof20andanymaterialnotsoremovedshallreverttotheSeller.Unmarkedtreesandyoungtimbershallbeprotectedagainstunnecessaryinjuryfromfellingandloggingoperations.IfhoweverunmarkedtreesarecutdamagesshallbepaidtheSellerattherateof$1pertreeperMbd.ft.forallotherspeciesandintheeventthatanysuchtreesarecutsaidtreesshallremainuponthepremisesandshallbethepropertyoftheSeller.NecessaryloggingroadsshallbeclearedbythePurchaseronlyaftertheirlocationshavebeendefinitelyagreeduponwiththeSellerorhisrepresentativeandanytreestoberemovedintheclearingoperationsshallfirstbemarkedbytheSeller.DuringthelifeofthiscontractandontheareacoveredcareshallbeexercisedbythePurchaserandhisemployeesagainstthestartingandspreadoffireandtheyshalldoallintheirpowertopreventandcontrolfires.AnyliabilityfordamagedestructionorrestorationofprivateorpublicimprovementsorpersonaldamagesoccasionedbyorintheexerciseofthiscontractshallbethesoleresponsibilityofthePurchaserandthePurchasershallsaveharmlesstheSelleronaccountofsuchdamages.Theriskiflossordamagetothetreeshereinpurchasedfromanyandallcauseswhatevershallbebornebypurchasersfromthedatehereof.ThePurchaserwillnotassignthisagreementwithoutthewrittenconsentoftheSeller.gTheSellerandPurchasermutuallyagreeasfollows:Allmodificationsofthecontractwillbereducedtowritingdatedsignedandwitnessedandattachedtothiscontract.Anyneedforreassignmentofinterestofeitherpartymaybechangedwithin10daysfollowingwrittenconsentbybothparties.Alltermsofthiscontractlegallybindthenamedrepresentativestoexcusethisdocumentaswritten.Thetotalnumberoftreesconveyedishavingavolumeofapproximatelybd.ft.composedasfollows:whiteoakredandblackoak•Incaseofdisputeoverthetermsofthiscontractfinaldecisionshallrestwithareputablepersontobemutuallyagreeduponthebypartiestothiscontract.Ifthepartiesheretodonotagreeuponathirdpartywithin10daysfollowingtheinitiationofthedisputeorinthecaseoffurtherdisagreementthenwithin15daysfromtheinitiationofthedisputeitshallbesubmittedtoaBoardofArbitrationofthreepersonsonetobeselectedbyeachpartytothiscontractandthethirdtobeselectedbytheothertwo.TheBoardshalldecidethedisputewithin5daysafterthematterisreferredtoit.IntheeventthatdamagesareawardedtotheSellerbytheBoardofArbitrationandarenotpaidonthedatethattheawardismadethenalloperationsofthePurchasershallimmediatelyceaseandiftheawardisnotpaidorsatisfiedwithin30daysafterthedateofawardtheSellermaytakeimmediatepossessionofthepremisesuponwhichthetimberislocatedshall。
